Recently, the General Office of CPC Central Committee and the General Office of the State Council issued the Opinions on Comprehensively Strengthening the Safe Production of Hazardous Chemicals (hereinafter the ‘Opinions'), and have circulated a notice requiring all regions and all authorities to implement the Opinions according to their actual conditions. 近日,中共中央辦公廳、國務院辦公廳印發了《關于全面加強危險化學品安全生產工作的意見》,并發出通知,要求各地區各部門結合實際認真貫徹落實。
The full text of the Opinions is as follows: 《關于全面加強危險化學品安全生產工作的意見》全文如下。
For the purposes of earnestly learning lessons from major and particularly serious accidents in some regions, comprehensively strengthening the safe production of hazardous chemicals, firmly preventing and resolving systemic safety risks, resolutely curbing major and particularly serious accidents, and effectively protecting the people's lives and property, the Opinions are hereby offered as follows: 為深刻吸取一些地區發生的重特大事故教訓,舉一反三,全面加強危險化學品安全生產工作,有力防范化解系統性安全風險,堅決遏制重特大事故發生,有效維護人民群眾生命財產安全,現提出如下意見。
I. General requirements   一、總體要求
With Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era as the guidance, efforts shall be made to comprehensively fulfill the spirit of the 19th CPC National Congress and the Second, Third and Fourth Plenary Sessions of the 19th CPC Central Committee, revolve around the coordinated efforts to implement the five-sphere integrated plan and four-pronged comprehensive strategy, and uphold the holistic approach to national security. There shall also be efforts to follow the requirements for high-quality development, focus on the prevention and control of systemic safety risks, improve and implement the work safety responsibility and management rules, and establish a system for the screening of potential safety risks, as well as the prevention and control of hazards. More efforts shall be made to control safety risks at the source in a comprehensive and precise way, and resolve basic issues, essential problems, and bottlenecks in this respect. Furthermore, steps shall be taken to rapidly modernize the work safety management system and capability for hazardous chemicals, improve overall safety in development, enhance work safety in a steady and constant manner, and create a safe and stable environment for economic and social development. 以習近平新時代中國特色社會主義思想為指導,全面貫徹黨的十九大和十九屆二中、三中、四中全會精神,緊緊圍繞統籌推進“五位一體”總體布局和協調推進“四個全面”戰略布局,堅持總體國家安全觀,按照高質量發展要求,以防控系統性安全風險為重點,完善和落實安全生產責任和管理制度,建立安全隱患排查和安全預防控制體系,加強源頭治理、綜合治理、精準治理,著力解決基礎性、源頭性、瓶頸性問題,加快實現危險化學品安全生產治理體系和治理能力現代化,全面提升安全發展水平,推動安全生產形勢持續穩定好轉,為經濟社會發展營造安全穩定環境。
II. Strengthening the management and control of safety risks   二、強化安全風險管控
1. Further screening and checking safety risks: The screening of safety risks and the management of potential risks shall be conducted in accordance with the Guiding Rules for the Screening and Management of Safety Risks in Chemical Industrial Parks (For Trial Implementation), the Guiding Rules for the Screening and Management of Potential Safety Risks in Enterprises Engaging in Hazardous Chemicals, and other relevant systems and regulations. The responsibilities of local party committees and government leaders shall be strictly implemented. Screening standards shall be specified according to actual conditions, and precise screening and assessment of safety risks shall be organized and implemented in enterprises engaging in hazardous chemicals, chemical industrial parks or chemical concentration areas (hereinafter referred to as ‘chemical industrial parks'). A safety risk database and a safety risk information management system shall be established and improved by categories of risks, and four grades of safety risk (red, orange, yellow and blue) shall be distinguished. Focus shall be put on grade-I and grade-II sources of hazards, as well as enterprises engaging in toxic, harmful, flammable and explosive chemicals. The most stringent measures shall be taken to manage and control safety risks according to the principles of ‘one policy for one enterprise' and ‘one policy for one industrial park'. In addition, an action plan shall be developed, and a three-year campaign on safety enhancement for hazardous chemicals shall be carried out. (一)深入開展安全風險排查。按照《化工園區安全風險排查治理導則(試行)》和《危險化學品企業安全風險隱患排查治理導則》等相關制度規范,全面開展安全風險排查和隱患治理。嚴格落實地方黨委和政府領導責任,結合實際細化排查標準,對危險化學品企業、化工園區或化工集中區(以下簡稱化工園區),組織實施精準化安全風險排查評估,分類建立完善安全風險數據庫和信息管理系統,區分“紅、橙、黃、藍”四級安全風險,突出一、二級重大危險源和有毒有害、易燃易爆化工企業,按照“一企一策”、“一園一策”原則,實施最嚴格的治理整頓。制定實施方案,深入組織開展危險化學品安全三年提升行動。
2. Stepping up industry restructuring: The policies and measures for the transformation and upgrading of the chemical industry shall be improved and promoted. The catalogue for guiding national industry restructuring shall be strictly implemented. The catalogue for eliminating outdated safety protection techniques and equipment shall be revised and published without delay. All regions shall, according to their actual conditions, develop, revise and implement the catalogue of ‘prohibited, limited and controlled' hazardous chemicals, eliminate production capacities that fail to comply with national standards, industrial standards and conditions for safe production on the basis of deepening the supply-side structural reform, and effectively prevent and control safety risks. Coordinated efforts shall be made throughout China so that outdated production facilities that have been eliminated in one place will be prohibited from being relocated to another place or industrial park, and those that approve or accept the relocation in violation of the provisions will be held liable according to laws and regulations. (二)推進產業結構調整。完善和推動落實化工產業轉型升級的政策措施。嚴格落實國家產業結構調整指導目錄,及時修訂公布淘汰落后安全技術工藝、設備目錄,各地區結合實際制定修訂并嚴格落實危險化學品“禁限控”目錄,結合深化供給側結構性改革,依法淘汰不符合安全生產國家標準、行業標準條件的產能,有效防控風險。堅持全國“一盤棋”,嚴禁已淘汰落后產能異地落戶、辦廠進園,對違規批建、接收者依法依規追究責任。
3. Implementing rigorous standards and regulations: Construction standards, identification conditions and management methods for chemical industrial parks shall be developed. Standards for the safe production of chemical, petrochemical and chemical-pharmaceutical products shall be consolidated so as to solve the problem of inconsistency, and the system of safe production standards for hazardous chemicals shall be established and improved. Standards for engineering design, construction, examination and acceptance of chemical products and hazardous chemicals shall be enhanced. Standards for design, manufacturing and maintenance of production equipment of chemicals and hazardous chemicals shall be increased. Faster moves shall be taken to develop the guiding rules for safety management in the chemical engineering process, standards for fine chemical reaction safety risk assessment, and other technical specifications. Leading chemical enterprises shall be encouraged to learn international standards and advanced practices in other countries, and develop standards that are more stringent than the average national or industrial standards. (三)嚴格標準規范。制定化工園區建設標準、認定條件和管理辦法。整合化工、石化和化學制藥等安全生產標準,解決標準不一致問題,建立健全危險化學品安全生產標準體系。完善化工和涉及危險化學品的工程設計、施工和驗收標準。提高化工和涉及危險化學品的生產裝置設計、制造和維護標準。加快制定化工過程安全管理導則和精細化工反應安全風險評估標準等技術規范。鼓勵先進化工企業對標國際標準和國外先進標準,制定嚴于國家標準或行業標準的企業標準。
III. Strengthening the safety management of the whole industrial chain   三、強化全鏈條安全管理
4. Strictly implementing safety management: All regions shall adhere to the principle of ‘doing what is right and not doing what is wrong', determine the positioning of the chemical industry, and establish a coordination and communication system for preparing a development plan for the chemical industry, which involves multiple administrative authorities in terms of development and reform, industry and information, natural resources, ecological environment, housing and urban-rural development, and emergency management. Provincial governments shall arrange the study and evaluation of safety risks of newly-built chemical industrial parks, and improve and implement measures for the management and control of these risks. For construction projects involving hazardous chemicals with ‘two primaries and one major' (hazardous chemical techniques under primary supervision, hazardous chemicals under primary supervision, and major hazard sources of hazardous chemicals), the relevant authorities of the people's government at or above the level of districted city shall jointly build a safety risk prevention and control system. If a high-tech industrial development zone or an economic and technical development zone with a chemical industrial park is to be established or a chemical industrial park is to be separately built, the relevant authorities shall improve and implement the measures for the prevention and control of safety risks, based on the completeness of its upstream and downstream industry chains, technical personnel, management capability, and other factors. Efforts shall be made to improve and implement the regulations regarding identification, assessment and registration of chemicals, effectively and accurately identify and assess physical hazards and toxicity of chemicals, and prohibit production and operation without prior preventive measures in place. (四)嚴格安全準入。各地區要堅持有所為、有所不為,確定化工產業發展定位,建立發展改革、工業和信息化、自然資源、生態環境、住房城鄉建設和應急管理等部門參與的化工產業發展規劃編制協調溝通機制。新建化工園區由省級政府組織開展安全風險評估、論證并完善和落實管控措施。涉及“兩重點一重大”(重點監管的危險化工工藝、重點監管的危險化學品和危險化學品重大危險源)的危險化學品建設項目由設區的市級以上政府相關部門聯合建立安全風險防控機制。建設內有化工園區的高新技術產業開發區、經濟技術開發區或獨立設置化工園區,有關部門應依據上下游產業鏈完備性、人才基礎和管理能力等因素,完善落實安全防控措施。完善并嚴格落實化學品鑒定評估與登記有關規定,科學準確鑒定評估化學品的物理危險性、毒性,嚴禁未落實風險防控措施就投入生產。
5. Strengthening safety management and control in key areas: Comprehensive assessment and standard identification shall be carried out in the existing chemical industrial parks. Safety review shall be conducted on newly developed chemical techniques. By the end of 2020, all chemical devices or storage facilities with ‘two primaries and one major' shall be equipped with an automatic control system, and all sources of major hazards shall be under online surveillance and monitoring. Coordination between the national development plan for oil and gas pipelines and other special plans, such as territorial spatial plans and transportation plans, shall be strengthened. Enterprises shall be urged to enhance the integrity management of oil and gas pipelines, improve the geographical information system for oil and gas pipelines, and strengthen the management and control of high consequence areas of pipelines. The statutory inspection system for oil and gas pipelines shall be strictly implemented, and the coverage of statutory inspection of oil and gas pipelines shall be increased. Safety management of parking lots for motor vehicles transporting hazardous chemicals shall be intensified and included in the information-based supervision platform. Supervision over the whole chain of transporting hazardous goods (including consignment, acceptance for carriage, loading and uploading, and vehicle operation) shall be strengthened. Standards for the design of storage tanks and other storage equipment for hazardous chemicals shall be raised. The establishment of a system of compulsorily monitoring atmospheric storage tanks for hazardous goods shall be studied. The passage of vehicles transporting hazardous goods through super-large bridges, super-long tunnels, and sources of drinking water shall be vigorously managed. Safety management of accessory storage areas for hazardous goods in seaports, airports and railway stations shall be reinforced. Safety management for the use of hazardous chemicals in enterprises, hospitals, schools, scientific research institutes and other entities shall be improved. (五)加強重點環節安全管控。對現有化工園區全面開展評估和達標認定。對新開發化工工藝進行安全性審查。2020年年底前實現涉及“兩重點一重大”的化工裝置或儲運設施自動化控制系統裝備率、重大危險源在線監測監控率均達到100%。加強全國油氣管道發展規劃與國土空間、交通運輸等其他專項規劃銜接。督促企業大力推進油氣輸送管道完整性管理,加快完善油氣輸送管道地理信息系統,強化油氣輸送管道高后果區管控。嚴格落實油氣管道法定檢驗制度,提升油氣管道法定檢驗覆蓋率。加強涉及危險化學品的停車場安全管理,納入信息化監管平臺。強化托運、承運、裝卸、車輛運行等危險貨物運輸全鏈條安全監管。提高危險化學品儲罐等貯存設備設計標準。研究建立常壓危險貨物儲罐強制監測制度。嚴格特大型公路橋梁、特長公路隧道、飲用水源地危險貨物運輸車輛通行管控。加強港口、機場、鐵路站場等危險貨物配套存儲場所安全管理。加強相關企業及醫院、學校、科研機構等單位危險化學品使用安全管理。
